Privacy Policy

This Privacy Policy describes how Slapsnacks, Inc. ("Slapsnacks," "we," "us," or "our") collects, uses, and shares information about you when you visit slapsnacks.com (the "Site"), sign up for communications from us, or otherwise interact with us. It applies to the Site and does not apply to the practices of companies we do not own or control, including retailers that sell our products or the third-party sites and platforms we link to or feature content from.

By using the Site, you agree to the collection and use of information as described in this Policy. If you do not agree, please do not use the Site.

1. Information We Collect

The Site is under active development and its features may change. This section describes the categories of information we may collect, depending on which features are active at a given time. We will keep this Policy current as features are added.

Information You May Provide Directly

Depending on which features of the Site are active, we may collect information you choose to give us, such as when you:

  • Sign up for our email newsletter or marketing list, if and when that feature is added (name and email address);

  • Contact us with a question, comment, or product inquiry (name, email address, and the content of your message);

  • Create an account or place an order, once Site checkout functionality is enabled (name, billing and shipping address, email, phone number, and payment information, which would be collected and processed by our payment processor and not stored by us directly);

  • Sign up to receive text messages from us, if and when we introduce SMS marketing (mobile phone number and consent record). 

Information Collected Automatically

When you visit the Site, we and our service providers automatically collect certain information about your device and browsing activity. This occurs whenever you visit the Site and does not depend on which optional features are active. It includes:

  • IP address, browser type, device type, and operating system;

  • Pages viewed, time spent on pages, referring and exit pages, and click activity;

  • Information collected through cookies and similar tracking technologies, described in Section 3 below.

We do not currently collect biometric or health information through the Site, and have no plans to.

Information From Third Parties

We may receive limited information from service providers that help us operate the Site, such as web hosting, analytics, and email delivery providers. We do not currently purchase personal information about you from data brokers, and have no plans to.

2. How We Use Information

Depending on which categories of information we collect from you, we may use that information to:

  • Operate, maintain, and improve the Site;

  • Respond to inquiries and provide customer support;

  • Send marketing communications about Slapsnacks products, promotions, and brand partnerships, where you have signed up to receive them;

  • Analyze Site traffic and usage to understand how visitors interact with our content;

  • Process and fulfill orders, communicate about orders, and prevent fraud, once checkout functionality is enabled;

  • Comply with legal obligations and enforce our terms.

We do not use your information to make automated decisions that produce legal or similarly significant effects concerning you.

3. Cookies and Tracking Technologies

The Site runs on the Shopify platform, which places certain cookies necessary for basic site functionality (such as load balancing and security) automatically. In addition, we and our service providers may use cookies, pixels, and similar technologies to:

  • Remember your preferences;

  • Understand how visitors use the Site (analytics);

  • Measure the performance of advertising, including through advertising or retargeting pixels (such as those offered by Meta, TikTok, or Google) that we may add to the Site.

You can control cookies through your browser settings. Where required by applicable law, we will honor recognized opt-out preference signals, including the Global Privacy Control (GPC), as a valid request to opt out of the sale or sharing of personal information and targeted advertising, to the extent those activities apply to your browsing session.

Social Media Features

The Site may include a feed or widget displaying posts from our social media channels. This feature, if active, is typically hosted or served by the social media platform itself (for example, Instagram or TikTok) or by a third-party service that connects to that platform. Loading a page containing this feature may allow the hosting platform to collect information about your visit, such as your IP address and the fact that you viewed the page, even if you do not click on or otherwise interact with the feed. This collection is governed by that platform's own privacy policy, not this one. We encourage you to review the privacy policy of any social media platform whose content appears on the Site.

4. Links to Third-Party Sites and Partners

The Site includes links to the websites of our partners, including Power Slap, Nitro Circus, and Thrill One. These are independent organizations with their own privacy practices. Clicking a link to one of these sites takes you away from the Slapsnacks Site, and this Policy no longer applies once you do. As of the date of this Policy, we do not share your personal information with these partners through the act of linking to their sites; if that changes, for example through a co-marketing arrangement, joint email list, or affiliate tracking, we will update this Policy to describe it before doing so. We encourage you to review each partner's own privacy policy before providing them any information.

5. How We Share Information

We do not currently sell your personal information for money. We may share information with:

  • Service providers who perform functions on our behalf, such as Shopify (site hosting and, when enabled, checkout), our email marketing platform, and analytics providers, each of which is authorized to use your information only to provide services to us;

  • Our contract manufacturer and logistics providers, if and to the extent needed to fulfill and ship orders once checkout is enabled;

  • Professional advisors, such as legal and accounting firms, where necessary;

  • Government authorities or other parties where required by law, subpoena, or other legal process, or where we believe disclosure is necessary to protect our rights, your safety, or the safety of others;

  • A successor entity in the event of a merger, acquisition, financing, or sale of some or all of our assets.

If our practices change such that they would be considered a "sale" or "share" of personal information under applicable state law, we will update this Policy and provide any required notice and choice mechanism before doing so.

6. Your Privacy Choices and Rights

Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, and to opt out of certain uses of it. A growing number of states, including California, Colorado, Connecticut, Virginia, and others, have enacted consumer privacy laws that grant some or all of these rights, generally to residents of that state and generally subject to applicability thresholds based on company size or the volume of data processed.

To make a request regarding your personal information, contact us using the information in Section 10. We will respond consistent with applicable law. We will not discriminate against you for exercising any privacy right you may have.

Marketing emails: any marketing email we send will include an unsubscribe link. You may also contact us directly to be removed from our list.

7. Children's Privacy

The Site is intended for a general audience and is not directed at children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete that information promptly.

8. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. Marketing list information, if collected, is retained until you unsubscribe or request deletion, or until it becomes stale and is routinely purged.

9. Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

11. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or for legal or operational reasons, including as new Site features are activated. We will post the updated Policy on this page with a new "Last Updated" date. If changes are material, we will provide additional notice as required by applicable law.
